My First Shot At A Vid!

Here's my first attempt at a vid!  I actaully got the idea from Brenton over at Aussielicious who published it a week ago. The vid is cool cuz it's just a dude being a dude having some fun by hitting the surf bare. But that's not what this post is about. I started thinking about the whole deal with this vid. There's like 3 guys in their early 20s hanging with a kid whos gotta be like 14.  And they all act like a 14 yr old walkinig around naked is not really out of the ordinary.  And what the hell is with the guy talking pics??  This would be in the American court system so fast it's crazy.  I mean it's kinda sad that we can't just be naked when we want to around who we want to. But I'm pretty sure I wouldn't want my 14 year old walking around naked around clothed 20-somethings drinking beer.  Is it a cultural thing? Am I too uptight?

    It is not the nudity that I question as nudity is natural and great. It is the drugs or personality disorders that the older ones seem to be displaying.....they personify my generations view of young slackers. The naked boy seems to think we don;t know what is between his legs as he gave up the use of his hand to keep it covered! IT looks to me like he is the younger bro of one of these guys and they dared him to surf naked. There is nothing sexual about this vid. I also am not sure the younger one is under 18. If he is, then you, Scott, are guilty of distributing child porn! Legally this is porn but in reality it is harmless!

    Americans are pathologically uptight. There's nothing wrong with this. It's atypical for Americans but just shenannigans for the rest of the world. If he showed dick it could be considered underage porn. Showing ass is hardly pornographic. Glad you posted it. Hope to see more vids.

  6. Big old nudist here... not sure why people freak out so much. I use to go to San Onofre Beach in So Cal when I lived down there... great place to surf naked. Miss that place... meet plenty of nudist families there... So Scott, what's the issue if your son wandered around nude?

  7. Who'd have thought our Scott with his first video clip could have scored a trifecta by hitting on three interesting points: public nudity, internet images of naked minors and pornography and the U.S. courts. Very impressive!
    When Brenton first posted this clip I told him I thought it was funny how guys will get naked w/out provocation but will always cover their junk. I guess it's not surprising. I think it was the "First Dude," some guy named Adam, who grabbed a fig leaf to cover his bits. It represented his loss of innocence. Different cultures react to public nudity differently. DUH! Americans are still trying to shed the cultural mores of their puritanical past. Public acceptance of nudity is changing albeit slowly.
    The gamekeeper in D.H. Lawrence's "Lady Chatterley's Lover" observed (and I'm paraphrasing) that real pornography exists only in the mind. Someone might view this clip (as I did) and think how nice it would be if we were all a little less uptight. Someone else might see the barefoot boy w/ cheeks of tan and drool. Different strokes.
    U.S. courts have struggled for decades over what constitutes pornography. We presently adopt the "community standards" test. In 1964, it was Justice Potter Stewart who first proffered, "I know it when I see it." The Supreme Court has ruled that "obscene speech/pornography" (which this clip is NOT) is "unprotected" speech. In other words, it does not enjoy 1st amendment protection and may even be criminal to express.
    Recent SCOTUS decisions pertaining to pornography and the internet such as: Ashcroft vs. ACLU, Ashcroft v. Free Speech Coalition and U.S. vs. American Library Association, Inc. have more to do w/ limiting a minor's access to obscene material and less to do with what constitutes obscenity.
    As for sex between adults and minors...I'm not going to touch that. Admittedly, I have VERY strong views on the subject and tend to get a little crazed. I'd only offer this...when in doubt...DON'T. There are a lot of nasty people in this world and there's a lot of very nasty shit out there in cyberspace. Fortunately, I have it on very good authority, that our justice system is a lot more sophisticated than most people think when it comes to dealing with blogs that traffic in kiddy porn.
    OK. Is anyone still awake? Funny how being captive at 30,000 ft. can make you chatty.

  10. it is definitely a cultural thing... Europeans do not have this total hangup with shame. The society in the U.S. has not been able to shed the Puritan mindset.
    I was in London in '79 and the BBC had full-frontal male nudity - Michael York at his young and hunky stage - during primetime TV.
    I keep trying to figure out WHY we're so ashamed of our cocks and balls here in this country. What is it? I mean besides listening to right-wing religious extremeists who just love to say "nudity is obscene" one minute, and "man is made in God's image" the next. So, in essence, what are they saying??? That God's body is obscene!! ...idiots.

  14. Scott, as much as I hate to do this, I highly suggest that you remove the video as soon as you can. You ARE in the US of A and, regardless of the harmless nature of this particular video, you DO have a blog with gay themes. And, I promise you, there are millions of right-wing bible-thumpers out there who would LOVE to grind you into the dust and then bury you under the jail as a registered sex offender. ~ GaySatyr

  15. I actually might have to agree with GaySatyr. This is Uptightland, and you don't want Google to take your blog down. But then, I also wonder why YouTube has it up.

    To your point, though...Nudity really isn't a big fucking deal. You go to a nude beach, and there are kids there. I don't think they're being exploited by anyone. They are just doing what kids do at a beach. So is everyone else.

    Nudity is way overrated by the conservative, and way underrated by everyone who doesn't enjoy it. It's how we should be. Nobody gets hurt by doing nude recreation. I think you're right that we take this way too seriously.

  16. Our American culture (what there is of it) has changed so much that I, also, would never let my 14 yr. old exposed to anything close to this. I could be held accountable if something happened. Like it or not, we live in a world where anything is possible, and adults are being held accountable as parents, adults, teachers, etc. for our youth. We can thank the Catholic Church for much of our anxiety. Does anyone remember the McMartin trial, that family was torn apart, but then American society has always been so puritanical. There are so many viewpoints to this video: purely harmless, all the way to child porn, andy everything in between.
    Just heard that the state of Virginia wants to eliminate any discussion of gay people in school for children in grades below 9th grade, saying that it's a parents right to open this discussion themselves with their children, not the duty of schools. Yeah, sweep gayness under the carpet, pretend it doenn't exist! Just the thing to make gay youth feel even more marginalized. (Sorry, Scott, I'll get off my soapbox!)

  17. Scott I like the vid, so thank you, it seemed like everyone was having a good time, but to be honest I think the dude is older than 14, and I think you know it too... but again seems like a good time had by all...

    I would like it if you continue these kind of vids maybe mix them up once in a while, beef dudes, dudes working out, dudes and chicks, 2 dudes and a chick,2 chicks and a dude,(well you get the picture) all doing fun stuff and some naughty stuff...lol....

    Don't ever get off of your soapbox when it comes to protecting gay teens. All kids are worth protecting and gay teens are kids. I wonder what they would say in Virginia to those who are bi?
    One day,society will wake up and realize, that doctors, lawyers, pilots, truck drivers, cooks, carpenters, plumbers, policeman, and the guy who pumps gas, just may be bi or gay. He is closer than you think.
    I remember one time, a guy saying, that he would not want a gay to touch him. I said, if you were in an accident and the guy who stopped to help you was gay. Would you say, don't touch me?

    my long winded and somewhat tedious comment was directed at the subjects raised by scott's post, not the video. lets give our scott some credit. as he noted, the video met the acceptable standards of YOUTUBE...there was nothing questionable about the video he posted. our scottie may be a little slow on the uptake sometimes but he's a responsible SOB and he's never posted ANYTHING that could be considered over the line. now as for his obsession w/ mutunt schlongs and dubious good taste...well that's another matter altogether.

  24. To counter the "if YouTube said it's ok, then it's ok" comment... YouTube has thousands of hours of new videos that are posted every hour. I've had some up there for months before not only were they taken down, but my account was blocked. They just wait until someone reports it, they check it out, then take it down. Since you only recently had your last blog taken down and the age of the surfer is in question, I'd also agree that to ensure your blogs stays up... it may be wise to remove the video. YouTube tracks where the videos are embedded -- their player reports back to them what page it's on (you can see the tracking data in the expandable graph section of most vids, unless the poster has turned it off) and if it gets flagged, then Blogger (both under Google) may likewise be notified. Just a friendly caution. Keep up the posts. :D

  25. Let me counter the "if it's okay for youtube" argument, also:

    This blog isn't youtube. It's a semi-x-rated blog exploring aspects of homosexuality. In the USA, that's an explosive subject often attacked as being pornographic, immoral and illegal, regardless of the merits of the attackers' arguments. And, all to often, their arguments prevail.

    Better to err on the side of caution than take a chance that someone would use something as innocuous as this goofy "I dare you" video as ammunition.

  27. I wouldn't go so far as to say he's clearly over 18, but he certainly looks much closer to 18 than 14 to me.

    And yes, I heard his voice. I still say he's at least 16/17, but in all likelihood over 18.

What someone LOOKS like and what they CLAIM to be doesn't much matter in the USA -- there is an entire segment of the law devoted to the very broad class of acts that come under the pornography statutes. Remember all those "Proof of age on file" banners at the beginning and/or end of videos. I seriously doubt that "Proof of age on file" exists anywhere for this video segment. And, ESPECIALLY in cases involving both homosexuality and naked young men, the authorities tend to convict first and accept proof of innocence only as a last resort. Worse, the accusers tend to convict on first contact -- never mind the rights of innocence until proven guilty and of a fair trial by a jury of peers. Ain't gonna happen.

    Please, play safely. Take the video down.

  29. I noticed some concern over the age of the nude surfer. I can confirm that Mitch is over 18. He's from Lord Howe Island in Australia and currently attending University. No underage nudity here so no need to take it down.
